Welcome to BALF Builder CRM. These Terms of Service govern your use of our application and services.

1. Acceptance of Terms

By accessing or using BALF Builder CRM, you agree to be bound by these Terms of Service, our Privacy Policy, and our End User License Agreement.

2. Description of Service

BALF Builder CRM is a construction management platform that provides:

  • Project and client management
  • Task tracking and scheduling
  • Document storage and management
  • Financial tracking (invoices and expenses)
  • AI-powered tools for construction professionals
  • Team collaboration features
  • Weather monitoring and alerts

3. Account Registration

To use our service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

4. SMS & Email Communications

BALF Builder sends transactional SMS and email notifications only to users who have completed our two-step consent process:

Step 1: An authorized administrator enables communications for your account.

Step 2: You explicitly opt in via a secure verification link or consent screen on first portal login.

No messages are sent until both steps are completed. Consent is never assumed. All users default to No Consent status until explicit opt-in is recorded.

  • Message Types: Task assignments, schedule changes, project updates, dispatch notifications, and appointment reminders. No marketing messages.
  • Frequency: Varies based on project activity
  • Rates: Standard message and data rates may apply

Opt-Out:

  • Reply STOP to any SMS for immediate removal
  • Reply START to re-enable SMS
  • Reply HELP for support information
  • Manage preferences in Portal Settings
  • Contact your administrator

All consent and opt-out events are logged with timestamps and IP addresses for compliance.

5. Subscription and Billing

  • Subscription fees are billed monthly or annually as selected
  • All fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Failure to pay may result in service suspension

6. Acceptable Use

You agree not to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or interfere with the service
  • Attempt to gain unauthorized access to our systems
  • Use the service for any illegal or unauthorized purpose

7. Data Ownership

You retain ownership of all data you input into the system. We do not claim ownership of your content. By using our service, you grant us a license to host and process your data to provide the service.

8. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We are not liable for any downtime or service interruptions.

9. Termination

Either party may terminate this agreement at any time. Upon termination:

  • Your access to the service will be revoked
  • You may request export of your data within 30 days
  • We may delete your data after 90 days

10. Limitation of Liability

To the maximum extent permitted by law, BALF SYSTEMS LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

11. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
